Resolution to Impeach
WHEREAS, United States House of Representatives rules allow for setting a federal impeachment in motion by charges transmitted from the legislature of a State or territory (Jefferson's Manual section LIII, 603); and
WHEREAS, The State of Florida and the former territory of Mississippi have established precedent by referring such charges to Congress, which in each case resulted in Congress ordering a Committee to investigate and report on the charges, and which in one case resulted in the impeachment hearings of Judge Charles Swayne of Florida; and
Article #l:
WHEREAS, George W. Bush has admitted that he willingly and repeatedly ordered the National Security Agency to conduct electronic surveillance of American civilians without seeking warrants with particularity from the FISA Court of Review, duly constituted by Congress in 1978 as the exclusive means for such surveillance, violating the Fourth Amendment to the U. S. Constitution, and Title 50 U. S. Code, Section 1805, all felonies; and
1 Fraudulently misinformed Congress, when this NSA program was made public after four years of covert operation, of grounds and practical constraints by which these felonies could be construed as permissible, grounds both strained and unrealistic: the need for speed on retroactive warrants, a need to violate covertly while incompletely informing Congress, the substitution of reasonable suspicion for required "probable cause," plus a mysterious "unitary executive" power; and
2 Had VP Richard Cheney report, under such grounds and practical constraints, only to highly restricted members of Congress on this National Security Agency spying program prior to its disclosure in public; and
Article #2:
WHEREAS, George W. Bush and Richard Cheney in violation of their constitutional oaths faithfully to execute their federal offices and, to the best of their ability, preserve, protect, and defend the Constitution of the United States, and in violation of their constitutional duty to take care that the laws be faithfully executed, committed a felony under Title 18 U. S. Code, Section 371 in that on March 19, 2003 they conspired to commit fraud and by executive order the United States of America invaded the sovereign country of Iraq in direct defiance of the United Nations Security Council. (A violation of Chapter 1, Article 2 of the United Nations Charter ratified by the Senate preventing attack without imminent threat, and is a violation of Principle VI of the Nuremberg Charter); and they:
1 Fraudulently misinformed the UN Security Council, Congress, and American voters, overstating the offensive capabilities of Iraq, including weapons of mass destruction, contradicting the results of ground inspections by United Nations teams, and rejected peaceful resolution by acts of UN compliance by Saddam Hussein; and
2 Repeatedly manipulated the sentiments of the American people with press statements and State of the Union assertions they knew from the Central Intelligence Agency to be false, including the claim that Iraq was seeking uranium from Niger and the claim that Iraq gave aid and comfort to the perpetrators of the terrorist attacks of September 11, 2001; and
3 Influenced, manipulated and distorted national
intelligence related to
the Pentagon, the indictment of the Vice President's chief of staff for lying to a Grand Jury, as well as a purging of career intelligence personnel who have subsequently given confirmatory evidence; and
4 Committed felonies under 18 U.S.C. 641 and 643 by transferring funds authorized for use in the war in Afghanistan and diverted it to an as-yet unauthorized build-up towards war in Iraq; and
Article #3:
WHEREAS, George W. Bush and Richard Cheney conspired to commit the torture of prisoners in violation of the "Federal Torture Act" Title 18 United States Code, Section 113C, the UN Torture Convention and the Geneva Convention, which under Article VI of the Constitution are part of the "Supreme Law of the Land"; and
1 Approved of torture under the name of stress and duress, held hundreds in detention for years, without charges, access to legal counsel, or legal remedy to challenge their detention, violated U.S. Army Field Manual provision 27-10, and signed H.R. 1815 with a statement indicating their future intention to disregard such laws and treaties; and
2 Designated human beings as undeserving of basic human rights, in violation of the Geneva and European Conventions and abducted and transported them to foreign countries where they could be subjected to inhumane treatment, even depriving US detainees of their Constitutional rights; and
Article #4:
WHEREAS, George W. Bush and Richard Cheney have repeatedly acted to expand the power of a "unitary" executive in violation of the principle of balance of power and the Constitution as the supreme law of the land; they have subverted and violated the principles of US democracy by impeding the legitimate functions of the Judicial and Legislative branches, and voters themselves, and have thereby violated Article II Section 1 and Article II Section 3 of the Constitution; and
WHEREAS,
Resolved by the legislature of the State of Montana, that our senators and representatives in the United States Congress be, and they are hereby, requested to cause to be instituted in the Congress of the United States proper proceedings for the investigation of the activities of the President George W. Bush and Richard Cheney, to the end that they may be impeached and removed from such office.
Be it Resolved further, that the Secretary of State of the State of Montana be, and is hereby, instructed to certify to each Senator and Representative in the Congress of the United States, and Office of the Speaker of the House, under the great seal of the State of Montana, a copy of this resolution and its adoption by the legislature of the State of Montana. The copies shall be marked with the word "Petition" at the top of the document and contain the authorizing signature of the Secretary of State.
